California Assembly Bill (AB) 141 passed the Senate on July 1st, 2021 and is expected to be signed into law by Governor Newsome. Some of the key highlights:
- Establishes the Department of Cannabis Control within the Business, Consumer Services, and Housing Agency.
- Revises the definition of “commercial cannabis” to include acting as a cannabis event organizer for temporary cannabis events.
- Revises the definition of “manufacture” to include package or label a cannabis product. The bill would remove the definition of “manufacturer.”
- Repeals the requirement for the Bureau of Cannabis Control to disclose information on its licensees. Certainly a welcome change for privacy concerns.
- Authorizes a testing laboratory to receive and test samples of cannabis or cannabis products from a licensed manufacturer or licensed cultivator for quality control purposes, and not for retail sale.
- Requires that the excise provisions not be construed to impose an excise tax on cannabis or cannabis products designated a trade sample.
